Yes, if you have an ECR passport and you are going to the UAE for a job, you need Emigration Clearance (EC) from India before you fly. You apply for it online on eMigrate, through an MEA-registered recruiting agent or through your UAE employer. If your passport is ECNR (no ECR mark), you do not need emigration clearance.
What is the difference between ECR and ECNR?
ECR means “Emigration Check Required”. ECNR means “Emigration Check Not Required”. Under India’s Emigration Act, 1983, ECR passport holders need clearance from the Protector of Emigrants (POE) to go for work to certain countries.
The MEA says many people are exempt from the ECR stamp. These include:
- People who passed matriculation (Class 10) or higher
- Income tax payers
- Professional degree holders
- Gazetted government employees
- People above 50, and children up to 18
If your passport is not endorsed as ECR, it is automatically ECNR. The word “ECNR” is not printed on passports.
How do I check if I have an ECR passport?
Open your passport and look for an “ECR” or “Emigration Check Required” stamp or printed line. On older passports it is usually a stamp near the front pages. On newer passports it is usually printed on the last page, the one with your address and father’s name. No ECR mark means ECNR.
If you have passed Class 10 since your passport was issued and it still says ECR, ask Passport Seva about getting it changed.
Is the UAE an ECR country?
Yes. The UAE is on the MEA’s list of ECR countries. Older MEA pages list 18 countries. The MEA’s April 2026 overview lists 19:
Afghanistan, Bahrain, Indonesia, Iran, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Oman, Qatar, Saudi Arabia, South Sudan, Sudan, Syria, Thailand, United Arab Emirates and Yemen. (The same document says clearance for Libya and Yemen is suspended.)
Emigration clearance is only needed for employment. An ECR passport holder going to the UAE on a visit visa, residence visa or study visa does not need it. At the airport you show your passport, visa and return ticket.
How do I get emigration clearance on eMigrate?
There are two legal routes. The Indian Embassy in Abu Dhabi explains both for UAE workers. Its page says direct recruitment is for employers hiring fewer than 10 workers in a year; bigger hiring goes through an agent.
Route 1: Through a registered recruiting agent
- The UAE employer registers on eMigrate and sends a demand to a registered agent in India.
- The agent handles your contract, insurance and clearance application.
- Check the agent first: on emigrate.gov.in go to Recruiting Agent > List of Recruiting Agents. Ask to see the original Registration Certificate.
Route 2: Direct recruitment by the employer
- The employer registers on eMigrate and gets the visa attested at the Indian Embassy or the Consulate in Dubai.
- The employer creates your employment contract on eMigrate. You both sign it.
- You buy PBBY insurance online through eMigrate.
- You apply under Emigrant > Apply for Emigration Clearance for ECR Countries, upload the signed contract, photo and insurance, and get an application number starting with EN.
- Pay the clearance fee online or at an SBI branch. After approval, download your clearance.
Kerala’s state agencies NORKA Roots and ODEPC are also registered. See our guide to Gulf jobs through NORKA and ODEPC.
What does PBBY insurance cost and cover?
Pravasi Bharatiya Bima Yojana (PBBY) is compulsory for ECR workers going to ECR countries. According to the MEA and the Indian Embassy in the UAE:
| Item | Amount |
|---|---|
| Premium | Rs. 275 for 2 years, or Rs. 375 for 3 years |
| Accidental death or permanent disability | Rs. 10 lakh |
| Hospital treatment | Up to Rs. 1,00,000 (Rs. 50,000 per hospitalisation) |
| Legal expenses | Up to Rs. 45,000 |
It also covers family hospitalisation in India, maternity for women workers, and return airfare in some cases.
How much can a recruiting agent charge?
Under the Emigration Rules, an agent can charge you a maximum of Rs. 30,000 plus 18% GST as service charge. Pay by bank transfer, cheque or demand draft and always get a receipt. Sub-agents are not allowed. If someone takes more, or the agent is not on the eMigrate list, it is a red flag. Read our fake job offers guide.
Is the new Overseas Mobility Bill law now?
No, not as far as we could find. In October 2025 the MEA released the draft Overseas Mobility (Facilitation and Welfare) Bill, 2025 for public comments. It is meant to replace the Emigration Act, 1983. In July 2026 it was still called a “proposed” bill, and we found no record of it being passed. So as of October 2026, the Emigration Act, 1983 and the current ECR rules still apply.

Quick answers
I have an ECNR passport. Do I need eMigrate?
No emigration clearance is needed. ECNR registration on eMigrate is voluntary.

Your ECR passport lets you travel on a visit visa without clearance, but you must not work on it. See our guide on job hunting on a visit visa.
Is PBBY needed for ECNR workers?
It is compulsory for ECR workers. Some professions need it too, so check with your agent or eMigrate.
Where do I see the clearance fee?
The fee is shown on eMigrate when you apply. We could not confirm the current amount, so check there.
This is general information, not legal advice. Check eMigrate, the MEA or the Indian Consulate for your case.
